Terms and Conditions 

Thank you for visiting our website, the following are the terms and conditions which apply to anyone visiting www.noonsaakin.com (from now on referred to as ‘Us’ or ‘We’).  By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms. If you do not agree to the terms stated in the below contract, please close this website. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. 

These terms and conditions may change at any time, without notice. Please ensure these terms and conditions are regularly checked as they will be the contract between us and yourself at the time of placing your order or at the time you access the website. There may be instances where terms located on certain products may replace certain parts of these terms and conditions. 

All of our products completions are stated as turnaround, this is defined as 'the process of completing or the time needed to complete a task' if in the instance we state a 'lead time' we mean turnaround. All our items have been handcrafted with great care and attention to detail. Please handle with the utmost care and delicacy. Do not tug at individual letters as they are for decorative purposes only. 

All preparation materials, visuals and sketches, including all electronic files used to create the project remain the property of Noon Saakin.

The Order Process 

All prices on our website are stated in Pounds Sterling (GBP). Once you have placed an order with us you will receive an order acknowledgment via email. This will include your order number, billing and delivery/collection details, an order summary and total you have paid. This will be classed as an acknowledgment email and your order will be processed the next working day. 

We may refuse to accept your order after you receive your acknowledgment email if: 

• The materials required for your order are not in stock 

• Offensive/unsuitable language used in any personalisation 

• We are unable to obtain authorisation for your payment 

• If there has been a pricing/product description error 

We reserve the right to cancel an order without explanation. 

The colours presented when you receive your order may vary from the digitalised images shown on a computer screen. We endeavour to ensure all colours presented are as close to the final product you’ll receive but cannot guarantee this. 

The turnaround for each product is stated on the individual product page. If the turnaround is stated a 'working days' this is typically Monday-Friday (excluding bank and public holidays). Orders will be available for collection the next working day or out for delivery according to the delivery option chosen at checkout. Orders comprising of more than 1 product will be dispatched on the latest turnaround time available in that order. If an order is completed sooner than the stated turnaround we shall notify you via email. We reserve the right to make slight modifications to our products, this may include (but is not limited to) adding our branding on the face of the product, adding or removing flourishes, the size of the plaque etc. 

For bespoke design requests please fill out this form and send us an email on orders@noonsaakin.com. Please note, any prices quoted via email, social media or via phone is valid for 7 days, we may be unable to honour the price quoted after this.

Personalisation 

If your chosen product allows for personalisation, please ensure all spelling and grammar is correct as this cannot be changed once your order is placed. We reserve the right to change the format of your personalisation (e.g., instead of writing '20th January 2021' we reserve the right to change this to '20.01.2021' etc.) We may contact you to make you aware of this beforehand but are under no obligation to do so. Each personalised product has it's own typography style. Different fonts may have different character variations which are used, we would be unable to change this. You shall receive the style pictured on your chosen product (if different fonts are pictured, please add a note at checkout specifying the style you would like). If you would like to use a different font which has not been pictured on the requested piece, please email us within 30 minutes of placing your order informing us on the style of font you would like. Please note, changing the font may cause a delay in the turnaround of your order. 

Once an order including personalisation is placed, this order cannot be cancelled or amended unless you have requested this in writing within 30 minutes of placing your order. If your request is received after this time, we reserve the right to go ahead with the order.

Discounts 

If a product has a discount applied, no other discount codes can be applied to the product, unless we have stated otherwise. 

If a discount code has been used and a refund has been issued, you will receive the cost for the product minus the discount amount. In the event of a partial refund the discount amount will be reduced from the price of the refund issued. 

If you have been issued a personal discount code, we do not permit you to share this with any other person(s), if we suspect your discount code is being abused, we reserve the right to cancel any orders using this code as well as discontinue the discount code. 

Discount codes cannot be used in conjunction with any other offers unless we have stated otherwise. 

Discount codes cannot be used on gift cards, unless we have a special offer on for the gift card. 

Discounts do not apply to shipping costs unless an exclusive code to reduce the shipping fee has been used.  

Discount codes used after the expiry date will no longer be valid and if an order is placed with an expired code, we reserve the right to cancel the order. 

We reserve the right to cancel a discount code without notice, cancel an order if we believe a discount code is being abused, cancel your order if you are unauthorised to use a particular discount code, make changes to these terms and conditions as well as any terms and conditions placed with the discount code. 

Discount codes apply to products on our website. If your order is comprised of a bespoke design your discount code will not be valid.

Delivery 

We use a range of couriers to deliver our orders as well as hand deliver. Your order will be delivered according to the delivery method chosen at checkout. In an order comprising of more than one product, your items will all be delivered together. If the items contain differing turnovers, the order shall be posted/available for collection on the latest turnover date. Your order may be complete before the turnaround time stated. Once your order is complete you shall be notified and additional handling charges may apply for collection orders if not collected within 5 working days.

On the occasion your order is sent out via a courier, a ‘signature upon receival’ option shall be chosen. If the wrong shipping address/postcode has been provided or the address is not a mainland UK address, we will attempt to contact you via email or telephone. If we are unable to contact you, we will hold on to your order until you contact us. Additional handling charges may apply, and we will not release your order until the additional charges are paid in full. If the address is not a mainland UK address, we will not release your product until the extra postal charges are paid in full. 

We cannot guarantee timescales or be held responsible for any postal delays. We cannot be held responsible for any failures that are out of our control. If you do not receive a delivery notification email once your order date has elapsed, we have no liability to you unless you contact us. 

Promotions for free delivery only applies to live products on our website. Bespoke Items or altering an item which is already live on our website will have an additional delivery charge which will not qualify for any promotions we have available for free delivery.

Free shipping would be for one address only, we are unable to deliver parts of your order to different addresses.

Promotions for free delivery are only available per order, if the order qualifies for any delivery discounts. We are unable to offer free delivery on multiple orders merged into one.

Order Cancellation 

As all our items are made to order you are unable to cancel an order once an acknowledgement email has been received. However, we may be able to cancel the order if the request is sent to us in writing within 30 minutes of placing your order. If your request is received after this time, we reserve the right to go ahead with the order.

Returns and Exchanges 

At NoonSaakin we are committed to ensuring each of our products are vigorously checked before we send them out to you. We pride ourselves in ensuring there are no faults in your pieces before they leave us.  

In the event you are not fully content with your order, please contact us using our contact form on the website and we shall be more than happy to help you. Where there is an error on our behalf, we will also be happy to discuss this with you. Please allow up to 5 working days for a response. 

In the event of a return, you will be responsible for the item until it reaches us. If any further damage/faults occur this cost will be reflected in your refund.  

 

We will not be able to offer a refund for the following items: 

• Items that have been personalised 

• Made to order products 

• Designer fees

• Clearance items

• Sale Items

 

If you have received the incorrect product, please get in touch with us within 14 days of the order being delivered and we will be happy to discuss the options available for you. 

If the item you receive is faulty, please get in touch with us using our contact us form on our website and we will get in touch with you requesting further information. If you are unable to provide any details we ask for we would not be able to proceed. You would be required to get in touch with us within 14 days of the order being delivered, any requests received after this may not be entitled for a full refund. If there has been misuse of our products, we would be unable to offer a refund. 

You shall receive the return address in your return confirmation we send to you.

If  your product is made-to-order we are unable to offer exchanges, please ensure the correct product/size/colour variation etc. is chosen before proceeding to payment.

Designer’s charges 

If your order requires our designers to design all or part of your order this charge will be non-refundable. The designer’s fees vary according to the style of order. Some examples of designer’s fees may be: 

• Bespoke design requests 

• Adding personalisation to an order 

• 3D Layered Arabic names 

• Made to order items

​

3D Layered Arabic Names Process 

Once an order for a 3D Layered Arabic name is placed, you shall receive design concept(s) in due course. This is usually within 14-21 working days, please note this is not a guarantee and your order will be complete within the turnaround stated on the respective pages. In order to receive your order within the turnaround stated we require you to respond to any correspondence from us within 72 hours of us sending you a message. If a response is received after this timeframe this could cause a delay on your order and we cannot be held responsible for this. 

The colours on the concept will not be the final colours used on your order, they will be used as a guide to represent the different 3D Layers. The colours used on your order will be the colours chosen when placing your order.

Art Work Installation

Our artwork installation service is designed to provide a permanent solution for your space. Once the artwork is installed, it cannot be removed without causing damage to the wall surface. Therefore, we do not offer a removal service once the artwork has been installed. We recommend that you carefully consider the placement of the artwork installation to ensure that it meets your long-term needs.

Holiday Closures

As we are a small family run business, there may be periods where we are closed for holidays, we will notify you of this when accessing the website and on our checkout page. During a closure, the turnaround for all order will be paused and will continue according to the information provided on the website at the time of placing your order.

 

Website Access 

Whilst we endeavour to ensure our website is available 24 hours a day, we cannot be held responsible if the website is unavailable at any time. Access to our website may temporarily be suspended without notice in order to carry out essential maintenance, system failures, or for anything else beyond our control. 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Not withstanding anything to the contrary in the foregoing, with respect to automatically renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Promotional emails and content 

You agree to receive from time-to-time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices – please notify us at any time.

Visitor Information and Visitor Conduct 

Personal identifiable data can be found on our Privacy Policy. Any information input into our website will be considered as non-confidential and non-propriety. When a transaction has been completed, we hold no record of any bank details. We will be able to copy, disclose or distribute and incorporate all material, data, images, text and other items embodied therein for any commercial and non-commercial purposes. 

Visitors to our website are prohibited from posting or transmitting any of the following material: 

• that is threatening, defamatory, obscene, indecent, seditious, offensive, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience 

• Anything which you have not obtained all necessary licences and/or approvals 

• Any information which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the UK or any other country in the world 

• You must not misuse the Website (including, without limitation, by hacking). 

We will happily and fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of the clauses of above.

Limitation of Liability 

To the maximum extent permitted by applicable law, in no event shall we, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.  
 
To the maximum extent permitted by applicable law, we assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or all personal information stored therein. 

 

If your use of material on this Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof. 

You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details. 

We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws. 

Customers must follow age restriction when purchasing a product. The buyer holds all liability if they buy or gift a product for under the age recommended.

Social Media Contact 

We are available on a range of social media platforms, including (but not limited to) Instagram, Facebook, Twitter, Tik Tok, Snapchat. Any contact you receive from us will be using Email. If we are unable to contact you via email we will try and contact you via phone. If this is unsuccessful and you have provided us with your Instagram details, we will contact you via Instagram from @noonsaakin. Our other social media platforms are purely to showcase our work and enquiries will not be dealt with on these.  

If for any reason you feel as though we are being impersonated or our social media accounts have been compromised, please immediately report this to us on DPO@Noonsaakin.com

Governing Law and Jurisdiction 

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the English courts.

Miscellaneous 

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. 

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions, which shall continue to have full force and effect. 

Only the parties to these terms and conditions may seek to enforce them. Nothing in these terms and conditions is intended as granting any persons who are not parties to these terms any rights under the Contracts (Rights of Third Parties) Act 1999.

Ownership of intellectual property, copyrights and logos 

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of ours. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. 

 

You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Third Party Site 

Our website may contain links to third party websites or online contents that are not under our control. These links are only provided for convenience, and we do not undertake any responsibility for such. A link to another website or service is not an endorsement of that site or service. No judgment or warranty is made with respect to such other services or sites. Your use of this third-party website or service is at your own risk. 

Indemnification 

As a condition of use, you agree to hold us harmless and be indemnified from and against all liabilities, losses, claims, expenses (including solicitor’s fees) and damages (whether direct or indirect) arising from or in connection with claims resulting from your use of this website, including without limitation, any claims or losses alleging facts that if true, would constitute a breach by you of these terms and conditions. 

Changes to the Terms and Conditions 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
