Terms and Conditions
1. Acceptance
1.a. Thank you for visiting our website, the following are the terms and conditions which apply to anyone visiting www.noonsaakin.com (from now on also referred to as ‘Us’, ‘We’ or 'Our'). By accessing or using the website of Our service, you (from now on also referred to as 'The Client') approve that you have read, understood, and agree to be bound by these terms. If you do not agree to the terms stated in the below contract, please close this website. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
2. Changes to the terms
2.a. These terms and conditions may be modified at any time without prior notice. We recommend you check them regularly, because any changes will apply from the time they are posted. The version in force at the time The Client places an order or use the website will apply. There may be instances where terms located on certain products may replace certain parts of these terms and conditions OR the terms and conditions may replace the terms located on certain products.
2.b. Your continued use of the Website or our service after any such change constitutes your acceptance of the new terms.
3. Our products and Intellectual Property
3.a. All products are hand made with care and precision. Please handle them gently for their intended decorative use only. Do not tug or push individual letters.
3.b. All design materials, visuals, sketches, electronic files and other preparatory work remain Our property. By submitting photos, videos or files (via the website, email, social media etc.), you grant us full ownership rights to use, reproduce, modify and distribute them at our discretion.

4. Order process
4.a. All prices shown on our website are listed in Pounds Sterling (GBP).
4.b. All of our products completions are stated as turnaround, this is defined as 'the process of designing and producing your order' if in the instance we state a 'lead time' we mean turnaround.
4.b.i. Turnarounds can be selected by The Client for most products. Where a selection is not available, turnaround information can be found under the 'Delivery/Turnaround' section of the individual listing.
4.b.ii. Unless stated otherwise, working days refer to Monday-Friday. Excluding Bank and Public Holidays.
4.c. Orders are only processed once full payment has been received.
4.d. Once full payment has been received, you will receive an acknowledgement email containing your order number, billing and delivery details, order summary and the amount paid. This email confirms receipt of your order and does not constitute acceptance.
4.e. The turnaround time begins from the next working day after payment is received (the next working day after the acknowledgement email has been sent).
4.f. If payment is delayed or held by the bank or payment provider, the acknowledgement email will not be issued until the funds have cleared.
4.g. We may still refuse or cancel your order after sending the acknowledgement if the materials required for the item is unavailable, the personalisation contains offensive or unsuitable wording, we are unable to secure payment authorisation, there is a error in pricing or the product description.
4.h. We reserve the right to cancel and refund an order without explanation.
4.i. Orders will be prepared for collection or out for delivery according to the shipping method selected at checkout. If your order contains more than one product, it will be complete based on the longest turnaround time on your order.
4.j. Colours shown online may appear differently when viewed on a screen, while we aim for accuracy in our product images, variations between digital previews and the finished product can occur.
4.k. We reserve the right to make adjustments to products, this includes but is not limited to, changes to branding placement, decorative details, plaque dimensions or other minor elements. These changes are made at our discretion and the client will not be informed in advance.

5. Bespoke Order Process
5.a. For bespoke design requests please fill out this form and send us an email on orders@noonsaakin.com.
5.b. Any price(s) quoted is valid for 7 days, we may be unable to honour the price quoted after this.
5.c. We can not be held responsible for any communication delays.
5.d. The turnarounds quoted for bespoke orders will be an estimated turnaround, whilst we will do all we can to ensure your order is completed within the timeframe stated, there may be instances where the turnaround may be delayed. We will notify you of this at our earliest convenience.

6. Personalisation​
6.a. If a product allows personalisation, it is The Client's responsibility to ensure the spelling, and grammar are correct at the time of placing your order.
6.b. We reserve the right to alter the format on any personalisation submitted without notice (e.g. changing '20.01.2021' to '20th January 2021').
6.c. We are not responsible for checking spellings, punctuation or verifying quotes, hadiths, ayats or poems. We will reproduce your personalisation exactly as you have submitted.
6.d. Each personalised product has its own typography style. Different fonts may have different character variations which are used, we would be unable to change this. You shall receive the style pictured on your chosen product (if different fonts are pictured, please add a note at checkout specifying the style you would like, if this is not done, we reserve the right to produce any of the pictured variations).

7. Discounts and Promotions​
7.a. If you use a discount code, it can not be combined with other offers unless we state otherwise.
7.b. Discount codes do not apply to gift cards, outlet items or shipping costs unless explicitly stated.
7.c. If you receive a refund, the discount proportion will be deducted.
7.d. Personal discount codes are for your use only.
7.d.i. If misuse is suspected, we may issue an invoice for the full price of your order, cancel any orders which have used the misused code or withdraw the code entirely.
7.e. Discount codes used past their expiry date are invalid and orders placed with these codes will be cancelled or an invoice will be issued for the full price of the order.
7.f. If your order has to be placed via invoice i.e. bespoke orders, discount codes will not apply.
7.g. If an invoice has to be issued for any reason stated above (in section 7), the turnaround for the order will be paused and recommence once the invoice is paid in full.
7.h. We reserve the right to cancel codes without notice.
7.i. If The Client has purchased or been gifted a Gift Card, this can be redeemed after 'Proceed to Checkout' is selected on the cart page, under the 'Redeem a Gift Card' section.
7.j. Please find our current discount codes and their terms:

Free Delivery- Automatically applied at checkout for orders over £124.99. Mainland UK only and multiple orders can not be combined into one. Only on live products. Invoiced, amended or bespoke orders do not qualify for free delivery.

5% off- Code provided once a picture or video of your Noon Saakin artwork displayed in your home is uploaded on this page.

8. Delivery/Collection
8.a. Your order will be out for delivery after the stated turnaround on the product(s).
8.b. We mainly use Royal Mail, UPS and Hand-Delivery to deliver our orders. Occasionally we may use alternative delivery partners.
8.c. Your order will be delivered according to the option chosen at checkout e.g. 1-10 working days after turnaround.
8.d. If your order contains more than one product, it will be complete based on the longest turnaround product in your order.
8.e. If a delivery partner (Royal Mail, UPS, etc.) deliver your order, a signature on receipt will be required.
8.f. If an incorrect address is provided and the order has left us, we would only be able to arrange re-delivery/send a replacement once the original product gets back to us.
8.g. Re-delivery will incur additional postage and handling charges.
8.h. If a delivery is returned to us and is made to order, we can not issue a refund, only arrange re-delivery, or offer the amount paid, back as store credit (minus additional handling fee's of £5 per piece). If personalised, only re-delivery can be arranged, we can not offer alternative options for personalised items.
8.i. We can not guarantee delivery times and are not liable for any postage delays beyond our control.
8.k. International delivery is available for all products excluding 3D Layered Art. If an international order is placed with an excluded product within the order, we will email you to discuss possible alternatives.
8.k. For International orders, The Client is responsible for any custom duties, import taxes, clearance fees or other charges applied by the destination country. These charges are set by local authorities and are outside of our control. We are unable to advise on or cover these costs. Failure to pay these charges may result in delays, returns or disposal of the parcel by the courier or customs authority for which we can not be held liable.
8.l. If your item(s) arrive damaged, please notify us within 10 days of delivery with the following pictures attached to your email, delaying this could mean we are unable to replace/offer a refund.
8.l.i. If Royal Mail is used to deliver your order, please send us the following four photo's:

8.l.ii. If UPS is used to deliver your order, please send us the following three photo's

A picture of the outside of the packaging box showing any visible damage. If there is no damage, please take one picture showing the top and two sides of the packaging that show the 'Fragile' and 'This way up' stickers.

A photo of the item inside the box, including the internal packaging materials.

A clear close up photo of the shipping label on the parcel, ensuring the tracking number is visible.
8.m. ​​​If collection is chosen and your order is not collected within five working days additional handling charges will apply at our discretion. The additional charges will start at a minimum of £1 per day we are open after the initial five working days lapse and depend on the amount of pieces and size of the artwork.
8.n. Once your order is available for collection, we will send you a collection email. This email will include instructions on how to arrange your collection.

9. Order Cancellation
9.a. If an item is made-to-order we can not cancel an order once you receive an acknowledgement email. You may request cancellation in writing within 30 minutes of placing your order, but this is not a guarantee if work has already started on your order. If your request is received after this time, we reserve the right to go ahead with the order or offer a partial refund.

10. Returns & Exchanges
10.a. We inspect all items before dispatch and aim to produce only fault-free products.
10.b. If your order has an error caused by us, or the item is faulty, please contact us within 14 days of delivery.
10.c. If a return is accepted, the client will be responsible for the item until it is delivered to us. If any further damage/faults occur than what has been reported to us, the cost to repair these will be reflected in your refund.
10.d. If a return is accepted and The Client paid for a quicker turnaround on the product, this charge will not be refunded (i.e. if you paid an additional £15 for a 5 working day turnaround, your refund will be the agreed amount minus £15)
10.e. Refunds can not be accepted for personalised items, made-to-order products, designer's charges or outlet items.
10.f. We can not be held liable if you have submitted an order with the incorrect size, colour, specification or personalisation. If you have submitted the incorrect details when placing your order, there will be a charge to amend (if amendment is possible) and fix this.
10.g. If you receive the incorrect product, you must notify us with within 14 days of delivery. We can not be held liable for receiving the incorrect product if you notify us after 14 days of delivery.
10.h. If the item is faulty, please contact us within 14 days of delivery with your order number and pictures of the fault(s) for us to investigate further. We would not be able to proceed without a valid order number. If the product was received as a gift, please ask the original Client for the order number.
10.h.i. If a fault is reported after 14 days, there may be a charge to amend any faults. Charging for faults is down to our sole discretion.
10.i. Refunds or exchanges will not be accepted if we suspect misuse of our products.
10.j. If a return is accepted, we shall send you the return address in the confirmation email. If You return a product without us accepting the return first, we have no liability to you until The Client contacts us and additional handling charges will apply.

11. Designer's charges
11.a If your order requires our designers to design all or part of your order, this charge is non-refundable. The charges vary according to the style of the order. Examples include (but are not limited to):

12. Installation Services​
12.a. We provide an installation service for most of our wall art.
12.b. To arrange an installation, please contact us with your order number and the following information:

Is there any furniture fixed to the wall or too heavy for two people to move in order to install your artwork (Sofa's, desks, cabinet's etc.)?

12.c. Our artwork installation service is designed to provide a permanent solutions for your home. Once installed, it can not be removed without causing damage to the wall surface or the artwork.
12.d. We do not offer a removal service once installed. Removal would be at the client's own risk.

13. Holiday Closures
13.a. As we are a small family run business, there may be periods where we are closed for holidays. We will notify you of this when accessing the website, on our checkout page and under this section (13) on our policies.
13.b. During a closure, the turnaround for all orders will be paused and will continue according to the information provided on the website at the time of placing your order.

14. Website access and visitor conduct
14.a. We strive to keep the website available 24/7, but we can not guarantee continuous access.
14.b. We may suspend or terminate access, at any time, without liability, for maintenance, system issues or any other reason including if you breach these terms or applicable law.
14.c. Any information The Client submits via the website or via email is considered non-confidential.
14.d. We do not retain your bank details after transaction completion, our payment providers might. We have no control over this.
14.e. We may copy, disclose, distribute and incorporate any visitor input (data, images, text etc.) and use it for commercial and non-commercial purposes.
14.f. You must not post or transmit content that is threatening, defamatory, obscene, indecent, discriminatory, misleading, infringing, unlawful, or otherwise objectionable.
14.g. You must not use the site to commit criminal acts, violate others' rights or misuse our site (e.g. hacking).
14.h. We will co-operate with law enforcement or court orders to disclose user identity or locate anyone posting prohibited material.
14.i. The Client may discontinue use and request to cancel your account and/or any services at any time. Not withstanding anything to the contrary in the foregoing, with respect to automatically renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which The Client has already made payment.
14.j. Personal identifiable data can be found on our Privacy Policy.

15. Limitation of liability and Indemnity
15.a. To the fullest extent of the law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, goodwill, use, data or other tangible losses) arising out of your access, or use of, our services.
15.b. We make no guarantee as to the accuracy or completeness of content, or that use of the site will be uninterrupted.
15.c. You assume all costs if your use of the site requires servicing, repair or correction of equipment, software or data.
15.d. You agree to indemnify us fully, defend and hold us (including our officers, directors, employees and agents) harmless from all claims, damages, losses, costs (including legal fees) arising out of your breach of these terms, your misuse of the website or any user account you authorise.
15.e. It is prohibited to access the website from territories where the contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk and are responsible for compliances with local laws.
15.f. Clients must follow age restrictions when purchasing products. The client holds all liability if they buy or gift a product for under the recommended age.
15.f. As a condition of use, you agree to hold us harmless and be indemnified from and against all liabilities, losses, claims, expenses (including solicitor’s fees) and damages (whether direct or indirect) arising from or in connection with claims resulting from your use of this website, including without limitation, any claims or losses alleging facts that if true, would constitute a breach by you of these terms and conditions. ​​

16. Intellectual Property Rights
16.a. The website, email addresses ending with '@noonsaakin.com' and all materials therein (designs, sketches, software, images, text, graphics, logos, trademarks, copyrights and other intellectual property) are our exclusive property.
16.b. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
16.c. If you upload or send us content (designs, images, illustrations, texts) you confirm that you own all rights or have the licence required. We are under no obligation to verify these and you will be liable for any costs associated with the content.
16.d. You allow us to publicly display your uploaded content.

17. Third Party Links
17.a. Our site may include links to third party websites or services that we do not control. These links are for your convenience only.
17.b. We do not endorse or warrant any third-party site. Your use of those sites is at your own risk.

18. Governing Law and Jurisdiction
18.a. These terms are governed by English law.
18.b. Any dispute arising from or relating to these terms shall be subject to the non-exclusive jurisdiction of the English courts.

19. Miscellaneous
19.a. You may not assign, sublicense or transfer any of your rights under these terms.
19.b. If any provision is held invalid by a court of competent jurisdiction, that will not affect the remaining provisions, which remain in full force.
19.c. Only the parties to these terms and conditions may seek to enforce them. Nothing in these terms and conditions is intended as granting any persons who are not parties to these terms any rights under the Contracts (Rights of Third Parties) Act 1999. ​
20. Promotional emails and content
20.a. You agree to receive from time-to-time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices, please notify us at any time.  ​​

21.a. We are available on a range of social media platforms, including (but not limited to) Instagram, Facebook, X, Tik Tok, Snapchat. Any contact you receive from us will be using Email.
21.b. If we are unable to contact you via email we will try and contact you via phone. If this is unsuccessful and you have provided us with your Instagram details, we will contact you via Instagram from @noonsaakin.
21.c. Our other social media platforms are purely to showcase our work and enquiries will not be dealt with on these.
21.d. If for any reason you feel as though we are being impersonated or our social media accounts have been compromised, please immediately report this to us on DPO@Noonsaakin.com​
